Alabama's 2021 amendment made its cottage food law one of the most permissive in the South, removing the sales limit and allowing online sales and in-state shipping for a wide range of shelf-stable foods.

Arizona allows broad direct-to-consumer sales of shelf-stable homemade foods with no revenue cap, requiring only a free registration and food handler course.

California offers two pathways: a two-tier Cottage Food Operation (Class A for direct sales, Class B for wholesale) and the MEHKO program (AB 626) allowing home-cooked meal sales in participating counties. Revenue caps are inflation-adjusted annually.

Florida has the highest cottage food sales cap in the nation at $250,000 with no permit, no inspection, and no food safety training required. Online and mail sales are allowed within the state.

Georgia's HB 398 (effective July 2025) dramatically deregulated cottage food by removing the license requirement, revenue cap, and adding retail store sales. You can start selling immediately with compliant labels.

Indiana is one of the most permissive states, requiring only an ANSI food handler certificate with no permit, no registration, and no revenue cap for home-based food vendors.

Iowa operates a two-tier system: Cottage Food operations have no revenue cap for shelf-stable items, while Home Food Processing Establishments can sell perishable and meat products with a $50,000 cap and additional licensing.

Michigan allows cottage food sales up to $75,000 (premium tier) with no registration, permit, or food handler certification required. Online sales, mail order, and third-party delivery are all permitted.

Montana offers two pathways for home food producers: a traditional cottage food registration ($40) or the Montana Local Food Choice Act which requires no licensing. Both have no revenue cap.

Nebraska's cottage food law was significantly expanded by LB 262 (2024) to include some TCS foods like cheesecakes and cream pastries. No revenue cap, and non-perishable products can be shipped within the state.

New Hampshire removed revenue as a licensure trigger in 2023. Operations under $20,000 are exempt at home/farmers markets; a $150 Homestead License enables unlimited wholesale, online, and mail order sales.

New Mexico's Homemade Food Act (2021) allows broad sales of non-TCS foods with no revenue cap and no state permit. Online sales and in-state mail delivery are allowed, but a Food Handler Card is required.

Ohio has one of the most permissive cottage food laws, allowing sales to grocery stores and restaurants without any licensing, registration, or revenue cap.

Oklahoma's Homemade Food Freedom Act allows a wide range of foods including some TCS items, with a $75,000 cap. A 2024 amendment added label privacy by allowing registration numbers instead of personal info.

Oregon's SB 643 (2024) raised the cap to $50,000 (inflation-adjusted) and defined cottage food as "all non-potentially hazardous foods." Retail store sales and online ordering are allowed. A Domestic Kitchen License enables higher-volume sales.

Pennsylvania's LFE program is uniquely permissive: no revenue cap, with wholesale, retail, online, and interstate shipping all allowed. The trade-off is a required registration, $35 annual fee, and one-time home inspection.

South Dakota allows a broader range of foods than most states, including perishable baked goods, home canned goods, and acidified foods (with lab testing). No permit or food handler certification is required.

Texas SB 541 (2025) tripled the cottage food cap to $150,000 (now inflation-indexed) and expanded to include TCS foods with DSHS registration. Local governments are explicitly prohibited from regulating cottage food operations.

Virginia allows cottage food sales with no revenue cap (except $9,000 for pickled/acidified foods) and no permit, inspection, or food handler certification. Online sales within the state are permitted.

West Virginia allows cottage food sales with no revenue cap, no permit, and no food handler certification. Online ordering and in-state delivery are allowed for non-PHF foods.
